These Terms and Conditions (“Terms”) govern your use of the Marguerite Rose website (margueriterose.co.uk) and the purchase of products from us. By accessing, browsing, or using our website and placing orders with us, you agree to be bound by these Terms. Please read them carefully before making a purchase. If you do not agree with any part of these Terms, you should not use our website or services.

“Marguerite Rose,” “we,” “us,” or “our” refers to Marguerite Rose, a business operating in England and Wales. “You” or “your” refers to the customer, website visitor, or any user accessing our website and purchasing our products. “Products” refers to the cut flowers, dried flowers, and any other related items or services we sell through our website. “Website” refers to margueriterose.co.uk.

When placing an order through our website, you confirm that all details provided (including billing, delivery, and contact information) are accurate and complete. Your order constitutes an offer to purchase a product from us. All orders are subject to acceptance by us. Once we accept your order, we will send an order confirmation email, which will specify the products ordered, the price, and estimated delivery details. A legally binding contract between us is formed when we send this order confirmation email. We reserve the right to refuse any order for any reason, including but not limited to product unavailability, errors in pricing or product description, or suspicion of fraudulent activity. If we refuse an order after payment has been processed, we will issue a full refund.

All prices displayed on our website are in British Pounds Sterling (GBP) and include Value Added Tax (VAT) where applicable, at the current rate. We reserve the right to change product prices at any time without prior notice, but any changes will not affect orders for which you have already received an order confirmation. Payment for all products and services must be made in full at the time of ordering. We accept payment via major credit and debit cards (e.g., Visa, Mastercard, American Express) and may offer other secure online payment methods such as PayPal, Apple Pay, or Google Pay. All payment transactions are processed securely by our third-party payment providers.

We make every reasonable effort to display our products as accurately as possible on our website, including their colour, texture, and appearance. However, actual products may vary slightly from the images due to factors such as monitor settings, natural variations in flowers, and lighting conditions. These minor variations are not considered a fault. For cut flowers, specific varieties and shades may be subject to seasonal availability and market conditions. In such cases, we reserve the right to substitute flowers of equal or greater value and similar style, ensuring the overall aesthetic and quality of your arrangement is maintained. We will always endeavour to inform you of significant substitutions where practical.

Delivery terms, charges, and available delivery areas (national vs. local) are subject to our separate Delivery Information policy, which forms part of these Terms. We aim to deliver products within the specified timeframes indicated at the point of order and in our Delivery Information. However, please understand that delivery dates are estimates and delays may occasionally occur due to unforeseen circumstances beyond our control (e.g., adverse weather, courier issues, traffic). We shall not be liable for any such delays. Risk of loss or damage to the products passes to you upon successful delivery to the address you provided. It is your responsibility to ensure that the delivery address is accurate and that someone is available to receive the delivery.

Cut flowers are perishable goods, and their longevity is highly dependent on proper care and environmental conditions. We provide general care instructions on our website, fresh flower care instructions. While we guarantee our cut flowers are fresh upon dispatch, we cannot guarantee their exact lifespan beyond this point due to factors outside our control. For dried flowers, we provide guidance on appropriate storage and handling to help maintain their appearance and longevity, dried flower care instructions. We are not liable for damage or deterioration resulting from improper care or handling by the recipient.

Our comprehensive cancellation and returns policy, including details on refunds and exchanges, is provided in our separate Refunds and Returns Policy, which forms an integral part of these Terms. Please refer to that policy for full details. Your statutory rights under consumer protection laws, including your right to a cooling-off period for certain online purchases, are not affected by these terms.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by English law. Subject to the foregoing, if we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. Our total liability to you for any loss or damage arising in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total value of the products ordered by you. We are not liable for any indirect or consequential loss or damage. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.
